1. Introduction

These Terms of Service govern your use of the ConsentMark website (consentmark.com) and any analytics governance services provided by Obscurity Ltd ("ConsentMark", "we", "us"). By using our website or engaging our services, you agree to these terms.

2. Services

ConsentMark provides analytics governance advisory services for regulated organisations, including governance diagnostics, framework implementation, and ongoing governance partnerships. The scope, deliverables, and fees for any engagement are defined in a separate Statement of Work or engagement letter agreed between ConsentMark and the client.

3. Accepting an Order Online

An order for the ConsentMark Monitor can be accepted online instead of on paper: in the dashboard, by pressing Accept on the order, or with an API key that holds the billing scope.

We keep a record of that acceptance: who accepted it (the person, or the API key and the person who issued it), the time, the IP address it came from, and the SHA-256 hash of the order document, so the record shows which document was accepted and not only that something was.

It is a record of acceptance. It is not a signature, and we do not describe it as one. Who in your organisation may accept an order is a matter for your own delegation of authority.

4. Acting through an API key

An Owner can issue API keys so that an AI agent or a script can use ConsentMark on the organisation's behalf. A key can do only what its scopes allow, and the Owner chooses those scopes key by key. In this section, "the Customer" is the organisation the key belongs to.

Every act performed with an API key, including accepting an order, accepting or retiring an expectation, and recording a lawful basis, retention period or transfer, is the Customer's own act and determination as controller, made on the authority of the person who issued that key, whom the Customer warrants holds that authority under its own internal delegations; ConsentMark records which key acted and does not determine, review or verify any basis, retention, transfer or authority it records.

5. Intellectual Property

All methodologies, frameworks, scoring models, tools, and proprietary processes used in delivering our services remain the intellectual property of Obscurity Ltd. Client-specific deliverables (reports, inventories, remediation roadmaps) become the property of the client upon payment in full. Clients may not redistribute, resell, or publicly share ConsentMark's proprietary methodologies without prior written consent.

6. Limitation of Liability

ConsentMark's analytics governance services are advisory in nature. We provide governance assessments, recommendations, and evidence-based reporting to support compliance efforts. Our services do not constitute legal advice and do not guarantee regulatory compliance. To the maximum extent permitted by law, ConsentMark's total liability under any engagement shall not exceed the fees paid by the client for the specific engagement giving rise to the claim. ConsentMark shall not be liable for indirect, consequential, or incidental damages.

8. Governing Law

These terms are governed by the laws of Ireland. Any disputes arising from or in connection with these terms or our services shall be subject to the exclusive jurisdiction of the courts of Ireland.

9. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation does not resolve the matter within 30 days, either party may refer the dispute to mediation before initiating formal legal proceedings.

10. Changes to These Terms

We may update these terms from time to time. The version and date at the top of this page identify the most recent revision. Continued use of our website or services after changes constitutes acceptance of the revised terms.
